with Nutri Centres Limited (Nutri Centre, we or us). Please read
them carefully as they affect your rights and liabilities under
the law. If you do not agree to these Terms and Conditions, please
do not register for or use the Site. Please note that to use any
of the services provided on the Site, you are required to register
as an authorised user on the site.
1. Use of the Site
1.1 The Site is provided to you free of charge for your personal
use subject to these Terms and Conditions. By using the Site you
agree to be bound by these Terms and Conditions.
1.2 These Terms and Conditions govern your use of the Site.
1.3 All orders and purchases made on the Site will also be governed
by the Product Terms.

2. Amendments

4.2 If Nutri Centre has reason to believe that there is likely
to be a breach of security or misuse of the Site, we may require
you to change your password or we may suspend your account in accordance
with paragraph 12 below.
5. Tesco Clubcard
Tesco Clubcard points are available on every purchase. For full

6. Promotional offers
6.1 Certain offers are only available for a limited period and while
stocks last. If you order is received after the offer period or
the goods are no longer available at the offer price, we will notify
you before we dispatch the goods.
6.2 Refunds for goods purchased under a promotional offer will
be based on the terms of the promotional price. Your statutory rights
are not affected.
7. Excluded Services
The services provided by the Site do not include the provision of
computer or other necessary equipment to access the Site. To use
the Site you will require Internet connectivity and appropriate
telecommunication links. We shall not be liable for any telephone
or other costs that you may incur.

harmful, vulgar, obscene, or otherwise objectionable material
b) transmitting material that encourages conduct that constitutes
a criminal offence, results in civil liability or otherwise breaches
any relevant laws, regulations or code of practice
c) gaining unauthorised access to other computer systems
d) interfering with any other person's use or enjoyment of the
Site
e) breaching any laws concerning the use of public telecommunications
networks
f) interfering or disrupting networks or web sites connected to
the Site
g) making, transmitting or storing electronic copies of materials
protected by copyright without the permission of the owner
h) Nutri Centre reserves the right to refuse to post material on
the Site or to remove material already posted on the Site.
9.2 You will indemnify us against all losses, liabilities, costs
and expenses reasonably suffered or incurred by us, all damages
awarded against us under any judgement by a court of competent jurisdiction
and all settlements sums paid by us as a result of any settlement

is defamatory, offensive or abusive, or of an obscene or pornographic
nature, or is illegal or constitutes a breach of any applicable
law, regulation or code of practice;

c) any fines or penalties imposed by any regulatory, advertising
or trading body or authority in connection with the use of the Site

10. Availability of the Site
10.1 Although Nutri Centre aims to offer you the best service possible,
Nutri Centre makes no promise that the services at the Site will
meet your requirements. Nutri Centre cannot guarantee that the service
will be fault free. If a fault occurs in the service you should
report it to the Customer Services (see below for contact details)
or by email at customerservices@nutricentre.com and we will attempt
to correct the fault as soon as we reasonably can.
10.2 Your access to the Site may be occasionally restricted to
allow for repairs, maintenance or the introduction of new facilities
or services. Nutri Centre will attempt to restore the service as
soon as it reasonably can.
11. Nutri Centre's right to suspend or cancel your registration
11.1 Nutri Centre may suspend or cancel your registration immediately
at our reasonable discretion or if you breach any of your obligations
under these Terms and Conditions.
11.2 You can cancel this agreement at any time by informing us
in writing. If you do so, you must stop using the Site.
11.3 The suspension or cancellation of your registration and your
right to use the Site shall not affect either party's rights or
liabilities.
11.4 Paragraphs 9,10,13,14,17 and 18 of these Terms and Conditions
shall survive cancellation.
12. Nutri Centre's liability
12.1 The Site is provided by Nutri Centre without any warranties
or guarantees. You must bear the risks associated with the use of
the Internet.
12.2 The Site provides content from other Internet sites or resources
and while Nutri Centre tries to ensure that material included on
the Site is correct, reputable and of high quality, it cannot accept
responsibility if this is not the case. Nutri Centre will not be
responsible for any errors or omissions or for the results obtained
from the use of such information or for any technical problems you
may experience with the Site. If Nutri Centre is informed of any
inaccuracies in the material on the Site we will attempt to correct
the inaccuracies as soon as we reasonably can.
12.3 In particular, we disclaim all liabilities in connection with
the following:
a) incompatibility of the Site with any of your equipment, software
or telecommunications links
b) technical problems including errors or interruptions of the
Site
c) unsuitability, unreliability or inaccuracy of the Site
d) inadequacy of the Site to meet your requirements
12.4 To the full extent allowed by applicable law, you agree that
we will not be liable to you/or any third party for any consequential
or incidental damages (including but not limited to loss of revenue,
loss of profits, loss of anticipated savings, wasted expenditure,
loss of privacy and loss of data) or any other indirect, special
or punitive damages whatsoever that arise out of or are related

12.5 Nothing in paragraph 12 applies to Nutri Centre's liability
in respect of products sold through this Site.
12.6 Nothing in these Terms and Conditions shall exclude Nutri
Centre's liability for personal injury or death caused by its negligence.
12.7 Our acceptance of an order takes place at the time you place
the order, at which point the purchase contract will be made and
you will be charged for your order.

and Sponsors are responsible for ensuring that material submitted
for inclusion on the Site complies with relevant laws and codes.
We will not be responsible for any error or inaccuracy in advertising
and sponsorship material.
16. Applicable Law
These Terms and Conditions shall be governed by and construed in
accordance with the laws of England and any disputes will be decided
only by the English courts.
17. International Use
Nutri Centre makes no promise that materials on the Site are appropriate
or available for use in locations outside the United Kingdom, and
accessing the Site from territories where its contents are illegal
or unlawful is prohibited. If you choose to access this site from
locations outside the United Kingdom, you do so on your own initiative
and are responsible for compliance with local laws.
18. Expiry Date on Payment Card
Please ensure that the expiry date of your payment card is after
the day that you place your order. Payment is taken at the point
of ordering the goods and in the event that the payment card has
expired we will be unable to take payment and fulfil your order.
19. Miscellaneous
19.1 You may not assign, sub-license or otherwise transfer any of
your rights under these Terms and Conditions.
19.2 If any provision of these Terms and Conditions is found to
be invalid by any court having competent jurisdiction, the invalidity
of that provision will not affect the validity of the remaining

ignores this, Nutri Centre will still be entitled to use its rights
and remedies at a later date or in any other situation where you
breach the Terms and Conditions.
19.4 Nutri Centre shall not be responsible for any breach of these
Terms and Conditions caused by circumstances beyond its control.
19.5 A person who is not a party to these Terms and Conditions
shall have no right under the Contract (Rights of Third Parties)
Act 1999 to enforce any term of these Terms and Conditions but this
shall not affect any right or remedy of a third party which exists
or is available apart from that Act.
19.6 These Terms and Conditions shall be governed by and construed
in accordance with the laws of England and Wales and any disputes
will be decided only by the English courts.
19.7 If any of these Terms and Conditions are held by any court
of competent authority to be unlawful, invalid or unenforceable,
in whole or in part, this will not affect the validity of the remaining
Terms and Conditions which will continue to be valid and enforceable
to the fullest extent permitted by law.

Please read these product terms and conditions carefully as they
affect your rights and liabilities under the law and set out the
terms under which Nutri Centres Limited makes the products available
to you ("Product Terms").
1. Prices
All prices are expressed inclusive of any VAT payable unless otherwise
stated. Payment is made strictly with the order. All prices are
subject to change without notice.
2. Availability
If for any reason beyond our reasonable control, we are unable to
supply a particular item, we will not be liable to you.
3. Acceptance
The purchase contract is made on ordering and paying for the goods
and delivery. You will be charged for the goods and delivery when
you place your order. There will be no contract of any kind between
you and us until you have purchased the goods. Up until payment,
we may decline to supply the goods to you without giving any reason.
At the moment the goods and delivery are paid for (and not before),
a contract will be made between you and us.
4. Delivery
4.1 Delivery will be made to the address specified by you on the
completed order form.
4.2 Parcels are dispatched to you by Royal Mail.

If the order exceeds the allowed weight we will contact the customer
to advise of the correct postage rate.

5. Returns of items
5.1 We hope you will be happy with your purchase. However, should
you feel it necessary to return an item, we aim to make the returns

We also pledge a 24-hour response time (Monday through Friday) on your e-mail requests. If for any reason you are unhappy with any product you have purchased from us, you may return it for a full refund (less shipping and handling). Only one opened package of any product is eligible for return. All others of the same product must be in a factory sealed container for refund. 5.2 Any damaged parcels or breakages must be notified to us within
three (3) days of receipt of the goods.

5.4 Please note that, in the event of a refund, all Clubcard points
received for the purchase of the refunded goods will be removed
from your Clubcard account.

6. Cancellation and changes

then it will be possible to cancel or amend the order as requested.
However if the order has been processed and despatched, then you
may wish to return the items for a full refund less any carriage
charges incurred.
7. Payment
7.1 You can pay by any American Express, Mastercard or Visa credit
card, Switch or Delta debit card. Your credit/debit card details
will be encrypted to minimise the possibility of unauthorised access
or disclosure. Authority for payment must be given at the time of
placing your order.
7.2 Our liability to you in connection with any order will not
exceed the total price charged for the relevant items.
7.3 We accept orders only from Web browsers that permit communication
